General terms and conditions of sale

These general terms and conditions of sale govern sales concluded on www.finisherzone.fr between FinisherZone and any consumer within the meaning of the French Consumer Code.

Article 2 — Purpose

These terms define the rights and obligations of the parties in connection with the online sale of display supports for sporting medals and race bibs, and related accessories, to consumers.

Article 3 — Prices

Prices are shown in euros, excluding delivery costs. Delivery costs are shown before the order is confirmed and summarised on the payment page.

FinisherZone operates under the French VAT exemption scheme. In accordance with article 293 B of the French General Tax Code, VAT is not applicable: the prices displayed are net prices, no VAT is invoiced and none can be reclaimed by the customer.

FinisherZone reserves the right to change its prices at any time. Products are invoiced at the price in force when the order is confirmed.

Article 4 — Ordering

The ordering process comprises the following steps: selection of products, review of the cart summary, entry of contact and delivery details, choice of delivery method, choice of payment method, and final confirmation.

Before confirming, the customer can check the details of the order and its total price, and correct any errors.

Confirming the order constitutes acceptance of these terms and forms the contract of sale. A confirmation e-mail summarising the order is sent to the customer.

Article 5 — Payment

Payment is due immediately upon ordering, by credit card, PayPal, Shop Pay, Apple Pay, Klarna or any other secure payment method offered on the site.

Payments are handled by certified providers. FinisherZone never has access to the customer's full banking data.

Article 6 — Delivery

Orders are prepared and dispatched within 24 to 72 working hours from France. Indicative times after dispatch: mainland France 2 to 5 working days; European Union 3 to 8 working days.

In accordance with article L216-1 of the French Consumer Code, FinisherZone undertakes to deliver the goods no later than thirty (30) days after the conclusion of the contract.

In the event of failure to do so, the consumer may terminate the contract under the conditions of articles L216-2 to L216-4, in writing on a durable medium, after having instructed the seller to deliver within a reasonable additional period. FinisherZone then refunds all sums paid no later than fourteen (14) days following termination.

In accordance with article L216-4, the risk of loss or damage passes to the consumer when they take physical possession of the goods.

In accordance with article L216-6, FinisherZone is strictly liable for the proper performance of the contract, whether the obligations are performed by itself or by other providers, in particular carriers.

Article 7 — Right of withdrawal

7.1 Principle. In accordance with article L221-18 of the French Consumer Code, the consumer has fourteen (14) days to exercise their right of withdrawal without having to give reasons or bear any costs other than those provided for in 7.4. This period runs from the physical taking of possession of the goods. In the event of separate deliveries, it runs from receipt of the last item.

7.2 Procedure. The consumer informs FinisherZone by any unambiguous statement: by e-mail to contact@finisherzone.fr, or by using the model form set out in article 12. No justification, photograph or reason may be required.

7.3 Return. The consumer returns the goods no later than fourteen (14) days after communicating their decision, to the address indicated by customer service.

7.4 Return costs. The direct costs of returning the goods are borne by the consumer.

7.5 Refund. FinisherZone refunds all sums paid, including the initial delivery costs (based on the least expensive standard delivery option offered), no later than fourteen (14) days from the date on which it is informed of the decision to withdraw. In accordance with article L221-24, FinisherZone may defer the refund until the goods are recovered or until the consumer provides proof of dispatch, whichever occurs first. The refund is made using the same means of payment as the initial transaction, unless the consumer expressly agrees otherwise.

7.6 Exceptions. In accordance with article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for goods made to the consumer's specifications or clearly personalised at their request. This exception does not apply to products sold in a standard version, including when offered on promotion, in a sale or as part of a bundle.

7.7 Diminished value. The consumer may be held liable for any diminished value of the goods resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the goods.

Article 8 — Legal guarantees

All products sold by FinisherZone benefit from the legal guarantee of conformity and the legal guarantee against hidden defects, independently of any commercial warranty.

The consumer has a period of two years from delivery of the goods to obtain the implementation of the legal guarantee of conformity in the event of a lack of conformity. During this period, the consumer need only establish the existence of the lack of conformity, not the date on which it appeared.

The legal guarantee of conformity entitles the consumer to repair or replacement of the goods within thirty days of their request, free of charge and without major inconvenience to them.

If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee. If the consumer requests repair but the seller imposes replacement, the legal guarantee of conformity is renewed for two years from the date of replacement.

The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract with a full refund upon return of the goods, if: 1° the trader refuses to repair or replace the goods; 2° repair or replacement takes place after thirty days; 3° repair or replacement causes major inconvenience to the consumer; 4° the lack of conformity persists despite the seller's unsuccessful attempt to bring the goods into conformity. The consumer is not entitled to terminate the sale if the lack of conformity is minor.

The rights mentioned above arise from articles L. 217-1 to L. 217-32 of the French Consumer Code.

The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund upon return of the goods.

Article 9 — Customer service and complaints

Any complaint may be sent to contact@finisherzone.fr. FinisherZone undertakes to reply within 24 to 48 working hours.

Article 10 — Consumer mediation

In accordance with article L612-1 of the French Consumer Code, the consumer has the right to use a consumer mediator free of charge with a view to the amicable resolution of a dispute, provided that they have first sent a written complaint to customer service and refer the matter to the mediator within a maximum of one year from that complaint.

Consumers resident in the European Union may also use the European Commission's online dispute resolution platform.

Article 11 — Applicable law and disputes

These terms are governed by French law. In the event of a dispute, an amicable solution will be sought as a priority. Failing that, the consumer may bring proceedings before the court of their choice among those with territorial jurisdiction under the Code of Civil Procedure, or the court of the place where they lived when the contract was concluded or where the harmful event occurred (article R631-3 of the French Consumer Code). As a consumer resident in the European Union, you also benefit from the mandatory protections of the law of your country of residence.
